Welcome to Passion Farms. These Terms and Conditions govern your use of our website
www.passionfarms.org, all purchases and wholesale services made through it.
Passion Farms is a brand operated by M&M HOLDINGS TX LLC (“we,” “us,” “our”), a limited
liability company registered in Texas. By accessing our site and purchasing our products, you
agree to be bound by these Terms and Conditions and our other posted policies.
Age Restriction
You must be at least 21 years of age to access this website, view our products, or make a
purchase. By using this site, you represent and warrant that you are 21 years of age or older.
We reserve the right to terminate any account, ban mails, IP addresses, and cancel any order if
we suspect that it is made by or for a minor.
Account Registration
To place an order, you must register as a member. All information you provide during
registration is accurate and we reserve the right to refuse service, terminate accounts, or cancel
orders at our sole discretion.
Products & Legality
All products sold on this site, including but not limited to THCA bulk flowers, Disposables,
Edibles, and Prerolls, are hemp derived and contain a delta-9 Tetrahydrocannabinol (THC)
concentration of not more than 0.3% on a dry weight basis, in compliance with the 2018 Farm
Bill.
User Roles
Our Site and services are intended strictly for business to business to customer (B2B2C)
transactions. Following are the user roles that we have on Passion Farms Marketplace:
- Â Seller: Businesses that purchase Passion Farms or their own products in bulk or retail for direct sale to end customer in their own retail establishments.
- Â Vendor: Businesses from which “we” and “Seller” source products. These relationships are governed by separate vendor agreements.
- Â Customer: End customers who can purchase the products from Passion Farms Marketplace.
Orders & Payments
All orders are subject to acceptance and product availability. We reserve the right to cancel any
order for any reason. Prices are subject to change without notice based on market fluctuations.
We accept the following payment methods: ACH, Debit Card, Credit Card, Bank to Bank
Transfer, Apple Pay, and Cryptocurrency. After payment escrow contract is made, payments are
only released after user receives the product.
Order Processing
Order processing time is approximately 1 to 14 days but varies based on the products or
services user choose. After payment confirmation, processing times may be longer for large
orders.
Returns & Refunds
Our Return and Refund Policy is mentioned in a separate page and is incorporated into these
terms for reference. In summary, we do not offer monetary refunds. In cases of product damage,
defect, or incorrect product delivery, our sole obligation is to replace the product. Please review
the full Refund Policy for eligibility and procedures.
Limitation of Liability
To the fullest extent permitted by law, M & M HOLDINGS TX LLC, its directors, employees, or
agents shall not be liable for any indirect, incidental, special, consequential, or punitive
damages, including without limitation, loss of profits, data, use, goodwill, or other intangible
losses, resulting from:
- Your access to or use of or inability to access or use the Site or our products.
- Any conduct or content of any third party (including Affiliate Members and their retail customers).
- Any unauthorized access, use, or alteration of your transmissions or content.
Our total cumulative liability to you for all claims arising from or related to these Terms or the
products shall not exceed the total amount you paid to us for the products or services giving rise to the claim.
Text Message Communications
If you access the Services from outside your home country, your information may be transferred
to servers or partners located in other regions, including the United States, where laws may
differ. By using the Services, you consent to these transfers.
Data Privacy
We may update this Privacy Policy from time to time to reflect changes in our practices,
technology, or legal obligations. We will notify you of any changes by posting the new privacy
policy on this page and updating the “Last Updated” date.
Opt-Out Option
Opt-out of text message communications. You may opt out of text messaging at any time by
replying to any message with STOP, contacting us at info@passionfarms.org. This will end the
communications from that particular phone number. You may continue to receive service-related
and other non-marketing text messages from other phone numbers managed by Company, and
you may opt out of those similarly.
Governing Law & Jurisdiction
These Terms and any separate agreements whereby we provide you services shall be governed
by and construed in accordance with the laws of the State of Texas, without regard to its conflict
of law principles. You agree to submit to the personal jurisdiction of the state and federal courts
located in Harris County, Texas, for any legal actions.
